CANNABIS EMPLOYERS – SECURE A LABOR PEACE AGREEMENT AT NO COST WITH THE TEAMSTERS

Our Union is Committed to the Industry

The Teamsters were critical allies in the coalition of employers, unions, criminal justice reformers, and others who successfully lobbied for the repeal of cannabis prohibition in the North Star State. At the federal level, our union has advocated for the SAFER Banking Act, the Small Business Tax Equity Act, the MORE Act, and the HOPE Act. The Teamsters also support the reclassification of cannabis under the Controlled Substance Act.

Our union is intimately familiar with the issues facing both employers and workers in the cannabis industry. The Teamsters represent cannabis workers all over the country, and we have relationships with both stand-alone businesses and multi-state operators.

LEADING THE WAY IN LPAs

Minnesota law requires anyone who wants a license to grow, process, manufacture, deliver, distribute or sell cannabis in the state to enter into a Labor Peace Agreement (LPA) with a bona fide labor organization (such as the Teamsters) that either represents or seeks to represent cannabis workers.
An LPA is a contract between an employer and a union in which the employer agrees to remain neutral during a union organizing drive. This means managers, human resources officers, executives, or anyone else who would be ineligible for union representation will not attack the union. This applies to speech in writing, in conversation, in a meeting, or in any other setting that has the potential to persuade a worker who might consider joining the Teamsters.

In exchange for neutrality, the Teamsters will not engage in picketing, work stoppages, boycotts, or any other economic interference with the employer.

Signing an LPA with the Teamsters does not automatically unionize your business, nor does it unilaterally impose a collective bargaining agreement. It just means the employer will agree to  

  1. a policy of non-interference.
  2. allow the union access to its workers (including the facilities).
  3. voluntarily recognize the Teamsters as the exclusive, legitimate collective bargaining representative as soon as a majority of the workforce sign authorization cards to unionize.
